Salley, Hite, Mercer & Resor regularly represents both national and state banking associations in commercial litigation in federal and state courts throughout the State of Louisiana. It handles retail banking litigation including disputes between banks and their customers involving negligence, unauthorized withdrawals, faithless bookkeepers, electronic funds transfers, credit cards, negotiable instruments, deposit account agreements, trusts, and commercial disputes under the Uniform Commercial Code. The Firm also represents financial institutions with regard to issues of privacy, fraud, forgery, conversion, breach of fiduciary duty, R.I.C.O., and theft. The Firm has defended banking and financial institutions in class actions as well as in FINRA and NASD arbitrations involving securities. The Firm is a member of the Bank Counsel Section of the Louisiana Bankers Association.
